This Consumer Health Data Privacy Policy supplements REPFIE Privacy Policy of REPFIE INC., a Washington state corporation, whose address is 7100 N Howard St., Suite R, Spokane, WASHINGTON UNITED STATES 99201 ("REPFIE," "We," "Us") and applies to personal data defined as "consumer health data" subject to the Washington State My Health My Data Act (MHMDA) ("Consumer Health Data").
As described in the Repfie Privacy Policy, Repfie offers a secure e-commerce software platform (the "Platform") for generating, managing, and monetizing digital media using artificial intelligence that leverages an individual's likeness, including a voice, image, and textual likeness.
This Consumer Health Data Privacy Policy explains how we collect, use, share, and safeguard Your Consumer Health Data when You use the Platform, mobile applications associated with the Platform, and any other digital services and websites related to the Platform that are operated by Repfie and its affiliates.
Please read this Consumer Health Data Privacy Policy carefully. If You do not agree with the terms of this Consumer Health Data Privacy Policy, DO NOT SIGN THIS CONSUMER HEALTH DATA PRIVACY POLICY AND DO NOT USE THE PLATFORM.
We reserve the right to amend the Consumer Health Data Privacy Policy at any time, for any reason.
Repfie collects Consumer Health Information, including: biometric data (including data related to your likeness and identity) and digital media bearing your likeness, information posted by you that may be indicative of your health information (such as posts, comments, and messages), and data derived based on your biometric data.
Consumer Health Data in each of the categories listed can be shared pursuant to Section 4 below.
Including your name, birthdate, and address.
PLEASE NOTE:
AI Identity NFTs, including associated identity signatures, hashes, and metadata, are public by design - EVERYBODY will be able to see them as they are on a widely distributed media. Whatever you put on blockchain records becomes permanently Publicly Available Information.
By using AI Identity NFTs, you are lawfully making your Consumer Health Data (including biometric data and other data related to your likeness) available to the general public.
These records are written to public blockchain infrastructure and are therefore permanent, immutable, and non-deletable - YOU cannot change these AI Identity NFTs bearing YOUR likeness once they are created. Neither Repfie nor any third party can alter, redact, revoke, or remove these on-chain records once they are created.
The Consumer Health Data can come directly from you, derived from digital media you provide, from Your interactions with the Platform (including through performing face verification and AI Identity NFT generation), and from third parties.
We use the Consumer Health Data to support your use of the Platform and in particular generating, managing, and monetizing digital media using artificial intelligence that leverages an individual's likeness, including a voice, image, and textual likeness on the Platform and implementing an e-commerce marketplace on the Platform.
We further use the data for: customizing Your experience of using the Platform; communicating with You about the Platform, including sending legally required notices; monitoring and analyzing usage and trends to improve user experience; ensuring the security and integrity of the information within the Platform; and complying with legal obligations.
We can share the Consumer Health Data only in the following ways:
MHMDA, and in particular RCW 19.373.040 provides certain rights with respect to Consumer Health Data, including rights to delete, or withdraw consent relating to such data, subject to certain exceptions.
Please note that Consumer Health Data that you chose to write on public blockchain is immutable – it cannot be altered or deleted and is available to the general public on a widely distributed media.
The rights further include the right to confirm whether Repfie is collecting, sharing, or selling Your Consumer Health Data concerning and to access such data, including a list of all third parties and affiliates with whom the regulated entity or the small business has shared or sold the Consumer Health Data and an active email address or other online mechanism that the consumer may use to contact these third parties.
